RESUMO

The present work objectives to demonstrate that legal protection of copyright can no longer be afforded in the form of property right. The qualification of this kind of intellectual rights emerged as a historical need to rename old privileges and persisted through the ambivalence of the concept of property. However, almost no specific rule of property is applicable to it. Copyrights are not susceptible of exclusive appropriation for they lack the characteristic of rarity. The scarcity artificially conferred by law became unsustainable in the Digital Age, especially in relation to goods transmitted over the Internet. Nowadays, phonograms do not need to be put under the form of atoms to be reproduced and distributed, as in the simple form of bits they circulate freely and without loss of quality, with a negligible cost. Indeed, intellectual rights and their expression must be protected as non-appropriable rights for their abundance makes it impossible to maintain the benefits derived from abstention imposed on others, typical of property rights. The emerging paradigm emphasizes the fact that is the use value of works that should reward authors creative spark since exchange value no longer exists.
