RESUMO

In this dissertation, the issue of the juridical efficacy on what concerns constitutional laws on social rights and its claim for the public powers will be analyzed, specially, on the Judiciary Power. This subject is not new, but it has an essential importance nowadays, once that the welfare state has never existed in Brazil and the needy population doesnât have access to the minimum basic social rights for a healthy and dignified life. The main objective of the study done is to give alternatives to the juridical and factual obstacles and the recognition of the positive efficacy and the social rights effectiveness, especially on what is related to problems originated by the âreserve of the possibleâ theory and from the classical conception of the separation of power principle. Initially, the general aspects of fundamental right theory are analyzed, necessary for the key concepts fixation about these complex subject. Next, it aboards the course of the cost of rights theory, discussing the idea that all rights have costs and need state action (including the classical freedom). On the middle of this paper, the juridical efficacy and the immediate applicability of the rights mentioned are analyzed by the observation if the most consistent model of efficacy â the positive or symmetrical â is applied to all effect of social rights or just to a minimum core of social rights clearly identified, having as a practical example, the right to health. Finally, the new role of the Judiciary Power on behalf to the challenge of concretizing the fundamental social auxiliary rights, as a condition to effectiveness of the Constitution
