Aplicabilidade do art. 475-J do Código de Processo Civil no processo do trabalho

RESUMO
The objective of this study is to analyze the possibilities of applying the fine foreseen (incorporated) in Article 475.J in the Civil Law Code, based on Law N11.232/2005, in a labor lawsuit. And for this, we seek, in the hermeutics, the scientific bases that support its application. although there are, in the Consolidation of Labor Laws, specific rules as to the time of execution. In the process of referring back to the roots of law, we discovered, in Ronald Dworkin, the philosophical foundation that can support the application of a 10% fine, foreseen in Article 475.J of the Civil Law Code, in the labor lawsuit. The roots of Dworkins ideas revolve around the possibility of incorporating in law the intrinsic values of society at any given historical moment. This transfer of values is made to the judicial field of action by means of judicial principles that, in addition to keeping the typical function of positivist thinking, begin to function as true rules replete with valuable contents. In the wake of Dworkin, the report on the origins of labor justice in Brazil (Justiça do Trabalho no Brasil) offers us elements to understand the need for a process linked to the application of law materials where this is appropriate. For this reason, an analysis of the principles that govern the processible law and work material is indispensable. As an instrument of the State jurisdictional activity, the process should value swiftness and firmly maintain the obligation to serve, with efficiency, the norms of material rights. The objective of Labor Law enforcement is to satisfy the creditors rights swiftly and efficiently, especially owing to the sustainable nature of credit. For this reason, the application of the fine foreseen in Article 475.J in the Civil Law Code in labor processes serves the constitutional principle that guarantees swift means to assure a reasonable term
