Reforma do Estado e terceiro setor: as organizaÃÃes sociais e os desvirtuamentos dos modelos de implantaÃÃo na AdministraÃÃo PÃblica brasileira

RESUMO

This study aims at analysing social organisations â also known as non-state public organisations (centered on general interest and situated outside the State sphere) -, which integrate the third sector in Brazil, and more precisely the social organisations established according to Law n 9.637 of May 15, 1998, and the civil society organisations of public interest constituted according to Law n 9.790 of March 23, 1999. However, it is not an analysis which is strictly related to the study of the nature, structure, dynamics, operation,regime, forms of control and the typical procedures of these institutions â although these specificities constitute a relevant and indispensable stage of investigation, as they will contribute to frame the research proposal. The aim is to examine in detail the associated essential concepts such as subsidiarity, partnership and civil society â, the national and international, political, economic and legal framework in which social organisations have been conceived, the predecessor types, the models which were used during the gestation process, the scopes aimed at according to the theoreticians, the differences and similarities between the adopted standards, the similar experiences lived in other legal orders, as well as â and fundamentally â the perceived deviations between the tenor of the implementation discourse of the referred non-state public organisations that are producers of social services and the reality of their establishment. These deviations have been reflecting in an incisive manner the incongruence and inconsistency of the state programme whose aim is to stimulate social initiative and democratisation â one of the cores of State Administration reform â or, in other words, the paradox of State reform in this respect, as the designed tool does not seem to fulfill the objectives of the plan â or at least the declared plans. In summary, this research consists of a critical analysis of the reform process of the Brazilian Public Administration concerning, in particular, the establishment of social organisations and civil society organisations of public interest considering the basic motive behind their implementation
