RESUMO

Water is vital for humans activity development and its use has to be permitted by a water grant. The water grants legal definition given by the Law n 9.433/97 expresses the sustainable development principle, since its purpose is to guarantee water uses control in terms of quality and quantity, and also enable the acess of water implicitly to present and future generations. In this context, the main goal of this Master thesis is to verify if water grant itself can be considered an instrument to the sustainable development. This inquiry led to the study of Piracicaba-Capivari-Jundiaí basins, whereas they are considered to be the forefronts basins in water resources management in our country. During the researches, was verified that the water grants given made the economic activities development possible, but did not provide the environmental sustainability, because of the waters quality degeneration, and neither the social sustainability, caused by the inefficient public healthy services and scarce life quality of the basins dwellers due to the negligence with domestic sewerages treatment, thrown direct on the basins. Nevertheless, the main result of this study is to find that water grant, in any basin, only can be considered sustainable, in other words, become an instrument to promote the sustainable development, if they are implemented within a feedback water management instruments system, within an integration between userssectors and water resources management sector, the preservation of multiple uses and waters quality and quantity indissolubility, and also the existence of water inspection on the users granted and non granted to guarantee the carry out of the law and the penalties application.
