RESUMO

The subject of this dissertation is whether, and to what extent, neoconstitutionalism is related to the problem of limiting and controlling political power and how its propolsals contribute to that task. Firstly, the aim was to demonstrate that neoconstitutionalists are among those who intend to limit government by law and, secondly, to demonstrate that, despite this, neoconstitutionalistsâ proposals contradict, to some extent, the idea of rule of law. It approaches the problem in a philosophical and sociological perspective and uses as techniques bibliographical research and some documental research. The dissertation is divided in two parts. The first one characterizes constitutional thought. In order to do that, it analizes some concrete constitutional experiences, namely English, North-american and French ones, and identifies essential notes in constitutional ideology, especially in its modern formulation. The second part defines the general idea of neoconstitutionalism and compares it to constitutionalism. The project draws attention to the insecurity associated to constitutional principles and to the problem of the decisions of constitutional judges as last decisions in the system and, thus, not subjected to legal control. The conclusion is that neoconstitutionalist model brings some risks to the rule of law.
