RESUMO

This work evidences that Brazilian statutory law lacks an autonomous procedural means for the perpetual rejection of invalid res iudicatae, and also suggests that the filling of gaps left by such lack of laws can be reached if querela nullitatis insanabilis is formally recognized. Brazilianâs dogmatic legal system only admits that the relative guarantee of res iudicatae can be attacked by either the use of the action for rescission of final judgment, or via the procedural tool named âstay of executionâ, both of them subject to numerus clausus hypotheses and short lapsing of time for the right of action term. The proposal of filling the gaps of Brazilianâs legal system is preceded by a summary of bibliography, court decisions and statutes of institutes which convey straight relationship with the proposed object of study, always emphasizing elements such as the procedural invalidity system, querela nullitatis insanabilis and res iudicatae. Res iudicataeâs qualities of being definite and intangible are discussed in critical perspective taking into account thoughts based on logical-formal methods, observing the diversity of judicial situations that come up with apparent, unconstitucional or even plenary null court decisions. It is considered that the relative authority of an intertemporal procedural institute should not prevail over either superior legal system values, neither over the principle of the supremacy of the Constitution. The conclusion is that the lack of laws related to an autonomous means of perpetual impugnation can be integrated into ius scriptumâs legal system by the acceptance and recognition of querela nullitatis insanabilis
