RESUMO

This dissertation Masters aims to treat the right to healthy environment as a fundamental human right, stressing since then the changes experienced in the contemporary legal paradigms, and as a breakdown of these ideas, addressing the Statement of Adjustment of Conduct and their importance for the better implementation of the principle of participation in environmental law and the promotion of consensus. The increasing globalization, the way it is being held, ultimately produce negative consequences for the environment as a whole as the heavy industrialization, the superexploração of cultivated land and development of biotechnology, accelerated urbanization. That resulted in more problems for the environment, as desertificações, air pollution, fires, deforestation, urban crisis, erosions, in short, shocking data that lead to global concern with environmental issues. Therefore, the rights of third generation, including the right to healthy environment, demanding new positions ahead of the problems related to it, because it can not be solved solely by the state, the provision of public services, or the creation of a particular group or organization , Either alone. Here, the Term of Adjustment of Conduct contributes greatly to the scope of social harmony and peace, creating, therefore, better access to justice and expansion of the democratic foundations of speech, analyzed by Jürgen Habermas, at the same time, embodies the participatory democracy and promotes education and environmental awareness among the participants, because they participate in the training of the title, is directly responsible for the obligations contained therein.
