RESUMO

This research has as target to know about administrative and legislative instruments apt to do the protection of the integrant cultural goods of the Brazilian incorporeal cultural patrimony. By virtue of the advance from the natural environment preservationist movement, in the same way it makes necessary the discussion about the protection of the Brazilian incorporeal cultural patrimony, as an effect from the globalization and economic pressures. It analyzes actions against the risk of the present and future generations adopting a progress model that forgets its past, not valuing and transmitting the proper meanings that have composed the essence of its ancestor. It finds bedding on the risk of disappearance of important carrying goods of reference to the identity, to the action, to the memory of the different groups which form the Brazilian society, as well as the expression forms, the ways to create, to make and to live by the rules of the Great Letter of 1988 (Constitution) and documents emitted from Unesco, with save end in the international plan of the incorporeal cultural patrimony of the humanity, reflecting specifically on the efficient instruments to the preservation of the Brazilian cultural environment and the total citizen cultural rights of action.
