Comissões parlamentares de inquérito como instrumentos de accountability horizontal: análise do período 19892005

RESUMO

The aim of this study is to determine if congressional investigative committees created in Brazils Federal Senate and National Congress after the promulgation of the Federal Constitution in 1988 can be classified as horizontal accountability tools. As far as methodology is concerned, the first step was to analyze documentation in order to gather data about the congressional investigative committees created between 1989 and 2005. The second step was to interview people that played an active role at congressional investigative committees, to assess the information thus obtained and relate it to the concept of horizontal accountability. The obtained results show that national legislatures in Brazil are failing to properly supervise and control the acts of the other branches of government. Out of the 91 committees created in the period under study, only 15 (16,5%) were successful in investigating crimes committed within the government and can thus be considered as horizontal accountability tools. Interviews with congressmen, public attorneys and National Congress staff members have shed new light on the meaning of some of the data collected. The effectiveness of the congressional investigative committees proved to be influenced by both internal and external factors. Among the external aspects, one should stress the Executive and the Judiciary interfering in Congress matters. Among the internal aspects, one should stress the behavior of the committee members and the adoption of fragile procedures. One can notice that the fact that only a small percentage of congressional investigative committees can be considered as horizontal accountability tools is made worse by the lack of coordination between the committees and the agents that eventually take over the investigation. Consequently, the subsequent legal actions produce poor results.
