RESUMO

This research analyses the Community Justice project, according to the neo-institutionalism approach, aiming at identifying how the project can influence the decrease of the justice system transaction costs and how it can stimulate the adoption of pacific dispute resolution practices in the communities were it is implemented. This analysis is developed in two moments: first, an evaluation of the design versus the implementation process of the Community Justice project is elaborated, aiming at verifying if the actions foreseen in its design are being implemented accordingly. Second, a comparison between the project and the formal justice follows. This comparison has focus on the reduction of transactional costs and on the voluntary adoption of pacific dispute resolution mechanisms. Based on the elements obtained from the analysis of the Community Justice project design and implementation and its contrast with the formal justice, some suggestions for the project improvement, as well as ideas for the design of an access to justice public policy with a major potential of impact in the violence prevention through the decrease of transactional costs and the adoption of non-violent practices for dispute resolution -, are presented.
