RESUMO

This work aims to investigate the role of the Third Sector regarding the implementation of the transindividual rights in the Brazilian Welfare State. At first the process of establishment of the Welfare State a new paradigm founded on the pillars of the supremacy of the popular clamor, of the preservation of freedom and of the equality of rights will be analyzed. In this scenario, the constitutional fundamental warranties and rights encompass values that are pervasive throughout the entire justice system and determine how the State, the society and the government act. Also, the consolidation of the institutions related to the collective process, a symbol of the broadening of the access to justice, has led to the advent of new words and categories of Law, namely the diffuse and collective rights. Starting from the instrumental or adjective point of view with a brief analysis of some relevant points of the collective process procedures (especially the origins and meanings of the expression diffuse rights), it is revealed that they are present in the 1988 Federal Constitution and in several scattered bills. The substantial core of the transindividual rights relates constitutionally to the fundamental rights and aims to protect the principle of the dignity of the human person in its most varied aspects. Finally, an investigation of the contemporary States role in implementing these rights will be undertaken, as well as an analysis of the mission of the Third Sector an important present social force which has multiplied its presence and influence exponentially after the 1970s and has brought to the surface the debate over the mission of the State and society. This new force has had a leading role in promoting citizenship and democratic participation amidst the economic globalization and massification. In the principle of subsidiarity, the cornerstone of the Third Sector in the administrative rights, lies the conflict between the must-be and being, since the private sector has been struggling to act towards the establishment of the transindividual rights
