RESUMO
The high level of informality in human settlements in Brazil requires an urgent juridical revision for implementing housing projects directed to low-income families, with greater articulation of housing issue, with urban and social policies. The Cities Statute/ 2001 ensured the social function of the urban estate and regulated the ZEIS, Special Zones of Social Interest: an instrument for ordaining the housing urban space production, both public and private, for meeting the needs of the citizens concerning life quality, social justice and the development of productive activities. The pioneering ZEIS procedure is the elaboration of Urban Plans based on land use and occupation norms adequate to the local scale, for groups in economic disadvantage. The study verifies the compatibilization of the specific legislation to the historical context and to the resulting social organization. It analyzes the application of the parameters introduced by this instrument, in a new urban project of a vertical condominium, located in an empty urban demarcated plot of land, destined to favela dwellers, in Santos. On the one hand, it verifies the construction of more inhabitable and more attractive communities deriving from the urban form provided by the applicability of the law in that community and, on the other hand, the measure of efficiency with the incorporation of management and new participation channels in housing design. Presupposed for qualitative assessment, the concept of HOUSING, since HABITAT I (1976), comprehends the housing unit and the urban integral system, and justify this multidisciplinary composition in the participative urban planning. As a practical result, the work may contribute to formulating housing policies based on the right to a democratic space besides realistically adapted to the local conditions.
