RESUMO

The objective of this work is to contemplate about the relationships among the feminine questions related to the world of the work in the public sphere and the format and the timing of the politics of labor social protection and welfare in Brazil. Specifically, I search for to understand the place of the feminine work in the social and labor legislation of the thirties in the range of the Constitution of 1934 debate. Was sought context as were built historically and legitimated the patterns of labor protection driven the Brazilian woman. It was fallen back upon the exam of the debates locked in the Assembly National Representative of 1934, where they were identified the central actors involved in this project and the main justifications that mobilized its accomplishment. The empiric research happened on the documental analysis of the Annals of the Assembly National Representative of 1934, among other important documents, as the Catholic magazine A Ordem, detached correspondence of the File Getúlio Vargas of the Centro de Pesquisa e Documentação de História Contemporânea do Brasil da Fundação Getúlio Vargas (CPDOC/FGV), etc; where the Analysis of Content was the methodology used to analyze the communicative process in subject. We were considered the legislation that regulates the work relationships as a privileged locus to reflect the dynamics of power of the modern society. In that perspective, it was fallen back upon the category gender in the analysis of the genesis of the labor legislation, facing a relative resistance of the use of this category in the study of the subjects of the field of the institutional politics. Along our investigation, we identified three active main currents in you debate it the regarding the feminine question: a first one classified as "extremely traditional"; one second denominated "moderate"; and a third identified as "avant-garde". The second current became singularly important for the fact of representing more exemplary the demands of your time. Their representatives looked for to promote the feminine emancipation without crossing the social limits of your time, for instance, without attacking the traditional sexual division of the work and the patriarchal family, being moved in a paradox, where, certain feminine emancipation was accepted at the same time in that she tried to maintain certain traditional social order. As for the justifications used for the establishment of a labor legislation differentiated for the women, these they based on factors of order moral, family, cultural, practice, religious and scientific (true or no).
