RESUMO

This research intends to define the state of the current European Union with a specific focus on its juridical nature. Within the context of this research, two distinct forms of the State are analyzed: federation and confederation, as well as the distinctive characteristics of each. In addition; the origin and evolution of the European Union, its institutional structure, and the most important treaties and enlargements are also examined. The study also focuses on constitutional law and on a future Constitution for the European Union with a foundation of the three major communitarian principals â democratic, superiority of community law, and subsidiarity â of the elements of the State present in literature, in citizenship, and in sovereignty, in an attempt to identify the state system which best fits with the context of the European Union. Finally, a conclusion is presented concerning the theoretical aspects studied, as well as the authorÂs positions and suggestions
