RESUMO

This study aims to investigate the incidence of medical liability in assisted reproduction techniques. To face the subject, the work presents a brief analysis of the main techniques used by addressing critical issues and controversies arising from each of them. Then it traces a brief history of civil liability, pinpointing some classifications to better understand the medical liability, by examining its legal status, its requirements and obligations that must necessarily be observed to prevent its incidence. It also deals with medical errors, their modalities, the blame for the conduct, the damage done, the causal relationship, the responsibility of the clinics and laboratories of assisted reproduction and bank deposit of fertilizer material, highlighting the excluding hypotheses of medical liability. To conclude, it makes suggestions de lege ferenda to regulate the subject
