RESUMO

Issues of public order have always been relevant to us due to the serious consequences they generate if violated.Because there is no legal regime previously determined by law, we sought to systemize public order issues based on that existing in the legal system in order to understand their nature and adequately present them, define them and understand the treatment logic they receive.The answers that we found are that public order is an institution designed to implement norms of this nature. Furthermore, we understand that public order generates a necessary plurality of imperative norms, although this does not guarantee that all are unrenounceable, with the perfect exercise of will in the field of activity that we call public order relative in counterpoint to absolute order.We approached public order in Foreign Law to compare the phenomena to those which have occurred in Brazil.In national law, we have observed that there is a great concern with associating public order in the area of civil rights with the theory of invalidities (absolute and relative nullities), reducing the scope of interpretation, especially by the Judicial Power.In the Brazilian Civil Procedure Code (CPC), issues of public order have an imperfect status, although traditional doctrine has created myths, such as: they do not preclude and are verifiable in terms of their official status, even though already decided.The dogmas established by the Civil Code and civil process, such that absolute nullity is always incurable and decreeable ex officio, are broken in our work in an attempt to awaken the academic community to a debate and, primarily, those who run the law, that public order is not formed rigidly and without renewal. To the contrary, it is fluid and mutable based on societys general interests
