RESUMO

The purpose of this dissertation is to analyze the possibility of harmonization regarding to the rules of the System of International Registration of Marks under the Madrid Protocol, that Brazil is considering to join, and the national legislation, mainly concerning the Articles 4 (1), 5 (2) and 5 (5) of that treaty, that stipulates term to the administration of origin - in Brazil, the INPI to notify any refusal to a registration applied through the international path - otherwise the registration will be considered granted, despites the examination of the legal requirements will not be made. Once the Law # 9.279/96 in effect in Brazil does not mention equal prescription, it nationals will not benefit from the term established by the Madrid Protocol, which requires deeper assessment of the question under the Equality Principle perspective, as set up by the Paris Convention and TRIPS as Principle of National Treatment, and by the Constitution and Industrial Property Law in force in Brazil
