O princípio da proteção à confiança nas relações contratuais entre o Estado e o agente privado

RESUMO

The present work treats with the principle of trust protection in contractual relations between the State and private agent. The State stands back from the empire position going to consensus position, interacting with a growing number of actors, through contractual relationships. The juridical-administrative regime to which such contracts are bound allows the use, by the Administration, of the prerogatives that allow the Public Power to interfere on the adjustments. Contractors interact with the Public Administration with the presumption of state action legitimacy and act according the morality and legality that is requested constitutionally. By the administrative action in general or by the use of prerogatives, contractors may have his expectations violated, generating adverse effects on economic activities by bringing distrust and instability in his relations with the State. It s necessary the protection of the legitimate trust deposited by contractors in the Administration. This protection is given by several principles, and the principle of trust protection is the one who more straightly assures individual expectations. This principle is deducted, in immediate way, from the principle of legal security and, mediate, from the principle of Rule of Law. Under obligation extent the principle of trust protection is closely linked to the principle of good-faith, in its objective aspect. This protection realizes in two ways: as limited changes to the legal situations, ensuring legal position based on trust or providing compensation to who had trusted and had his trust violated. A confidence violation, given the special characteristics of the administrative contracts, can take place on three moments: in the pre-negotiation, during the contract and in the post-contract. In each one of these stages, by causing some affront to the principle of trust protection, will the Administration be responsible for the reparation of the private damage. The principle of trust protection seems to be essential to the rescue of Public Administration s confidence.
