RESUMO

The object of this thesis is the Municipal Autonomy and its limits in the political-administrative organization of the Federative Republic of Brazil. The general objective is to search, analyze and describe the municipal autonomy and its limits in the political-administrative organization of the Federative Republic of Brazil based on the current legislation and on the predominate doctrinal understanding. The present work was divided into three chapters. In the first chapter, I dealt with the historical development of the Municipality within the Brazilian juridical order, its concept, and characterization as a federal being; I also dealt with the current political administrative organization of the Federative Republic of Brazil (Federation) and the constitutional principles related to it. Finally, I analyzed the municipalities of five countries: Portugal, France, Germany, Spain, and United States of America. In the second chapter, the principle of municipal autonomy is specifically discussed, with which I tried to present its operational concept by analyzing the autonomy of Municipalities in the constitutional juridical order existing before and during CRFB/88 application as well as its subdivisions. The third chapter presents the identification and analysis of some limitations established by the CRFB/88 over the constitutional principle of the municipal autonomy, some political, social, and economic restrictions, and the institute of intervention
