RESUMO

It deals with the relationship of the environment with the development and globalization, as well as the need of its judicial protection, analyzing some of the important principles that guide the environmental right. The second proposes the analysis of the protection of the environment by the international environment right, focusing the documents, which deal with the environmental issue related to development, as well as those that suggest the reduction of gases of greenhouse effect as a way to reduce the effects of global heating and climate changes. The third chapter exposes about the country?s environmental right, with emphasis on the normalization related with the impacts originated from the biofuel production. In the second part of the dissertation, on the judicial political context of the adoption of biofuel- three chapters are included. The first, tries to explain, after a brief historical of its evolution, the role of the State, in promoting the development, especially the sustainable, as well the appearance of new pertinent public policies adoption demands, due to the emergency of the environmental issue. We try to identify how the State has reacted with the environmental demands, specially in the last decades of the XX century, when the protection of the environment was internationally discussed and the protection was constitutional in several countries. After it refers to the energy policy of the Brazilian state. In the second chapter, the three nuclear issues are discussed which fundament the production of clean renewable energies, the climate changes, the crisis and the world?s oil dependence and its consequences, as well a potential international market . After, in the third chapter, a specific study on the production of ethanol and Biodisel in Brazil, with their regulation specific regulating marks, its environmental, social and economical impacts, especially approaching how the Brazilian environmental legislation is prepared to face the externalities caused by the production of those fuels.
