RESUMO

ABSTRACT This work contains analysis of "Human Right to Family" under Brazilian and International law (including doctrine and jurisprudence), with emphasis on principles pertaining to "Child and Adolescent Rights". The right to family life is essential to children and adolescents, according to the Federal Constitution. The importance of this right is highlighted by the fact that in Brazil there are 20,000 (twenty thousand) sheltered children and adolescents unable to reach maturity under the refuge of a family. The analysis starts with the systematic identification of principles related to the Brazilian "Child and Adolescent Rights" on the 1988 Federal Constitution, particularly the "Principle of Human Dignity". This principle is a springboard to the "Principle of Full Protection" and to the acknowledgement that children and adolescents are subject to and protected by law. A special attention was given to the supersede of discriminatory classification of children and adolescents as "minors" in regular situation and "minors" in irregular situation. The research of "family" as a concept of the Brazilian Civil and Constitutional Law led to a proposition for a new definition for "family", specific to the "Child and Adolescent Rights" and to the concept of family life. Further study was conducted on legal instruments that guarantee family life, including general aspects of protective measures, specially "sheltering" and "placement with foster family" by means of custody, adoption and guardianship. The conclusion is that the Brazilian legal system is advanced and coherent, containing the legal means to guarantee family life. Notwithstanding, there is a large gap between the legal world and the socio-cultural reality, where social exclusion and institutionalized practices are predominant.
