RESUMO

The jurisdictional control of the administrative discretional is allowed when the Public Administration overflows the limits prescribed for the juridic system that condition the edge of freedom conferred for law the administrator so that this, according to objective criteria and in accordance with the chance and convenience of the act, can reach the legal purpose. The trespass to such limits makes possible the action of the Judiciary Power in the direction to adjust the administrative behavior again to the legal system, having a relation of proportionality between the administrative discretional and the jurisdictional control, in such way that the reach of this control in relation to the discretional acts of the Administration is not circumscribed only to the legality, in a solitary context, but to also enclose its compatibility with the constitutional principiology, under which if the principles find agglutinated all regents of the state activity, amongst which the administrative morality
