RESUMO

This paper analyses the re-structuring of the National States, between the 1980s and 1990s, which eliminated the existence of a model of strong intervention and aimed more flexible models. These changes were stimulated by both the Welfare States crises (a financing crises) and by pressures which arose from the appearance of the Information Society. The adopted reforms in order to implement a change in the concept of State were mostly liberal. Nevertheless, neoliberalism could not achieve its goals totally, since the impossibility of the practical adoption of a minimum State was already known. A Regulatory State is what arose. This Regulatory State, based on transparency, flexibility and efficiency, would guarantee certain autonomy to the markets and, whenever it were necessary to protect the publics interest, be also firm. A particular case of this reformation occurred in the telecommunications sector, a vital area for the constitution of the Information Society. The reformation in this sector demonstrated the removal of the State as a supplier of products and service, which made its liberal character evident as it created a public agency (ANATEL). This agency, on behalf of the National State, is supposed to regulate the telecommunications in Brazil and, at the same time, guarantee the development of the sector in order to assure its constant evolution and perpetuity and keep the infrastructural basis of the Information Society working. This paper is a study of ANATEL representing the State. It analyses and focuses mainly on: 1. whether ANATELs legal structure is consistent with the regulation theories; 2. whether it has the means of interaction with society and in what ways the instruments it has for that interaction have been used. It has come to the conclusion that ANATEL does posses the necessary instruments to represent the State but it fails in terms of the participation of the civil society in the regulation process.
