RESUMO

The present study aims to reflect on family institution from social-historical perspective, looking at parenthood and guard of minors within broken families. This treats about a documental research of qualitative incuse, having by referential judicial proceedings allusive to the dispute between begetters. It focus theoretical and conceptual aspects of mono-parental guard as predicted on Brazilian Right in which one parent is identified with âbetter conditionsâ to guard the minor. While the other parent, assumes the role of a visitor or an inspector. Such model seems to match an ideology that places woman with a natural capacity to take care of children, as she has been traditionally responsible for most guards. The study reflects on the limits and contradictions of this standard, presenting the âjoint guardâ as an alternative with better conditions to parenthood on equalitarian bases, identifying its viability and impediments
