Ética do discurso e relações empresariais : o confaz enquanto instância comunicativa e sua importância diante do pacto federativo

RESUMO

The effects of globalization and the increasing intervention of the State in the ambit of economy unleash effects that reach the sphere of entrepreneurial relationship. This fact has produced the necessity of rethinking the way this intervention is done in order to compose or diminish the unbalanced results, and that represents one of the challenges to the so called contemporary society. The globalizing economical model is already consolidated and causes reflexes and consequences in the whole society structure, demanding the application of procedures that lead to ruling actions that are able to preserve collective values. In this sense, the discursive theory developed by the German thinker Jünger Habermas, based in the building of a procedural democracy allows to guarantee an ample social debate preserving juridical normality and constructing the democracy in accordance to consensual rules. These very consensual rules are supposed to preserve the legitimacy of ruling and promote to overcome contradictions caused by the State intervention. The approach of the federative agreement and the difficulties in regulating the planning of business relationship, mainly facing the outcome of social and economical unbalances originated from the so called “tax war” that blew up among the States of the Federation because of the unilateral concessions of fiscal incentives as an appeal for the installment of new plants, shows a pragmatist view of the subject in which councils such as CONFAZ – Treasury Police National Council take their role in real communicative instances to ensure the establishment of argumentative speeches that make possible to apply the communicative action theory oriented by ethics on speech and, consequently, to obtain legitimate consensual rules.
