RESUMO

The modern stage of globalization - technological and free of borders increased the competition and obligated the players of world market be competitives. The commercial societies looked for new customers over nacional borders. To be sucessuful, joined forces by enterprise concentrations and started disputing the international market as big world companies. The weakness of National States created non regulatory zones that are now occupied by privileged players: transnacional companies, wich reorder the world map, in economic and politic terms. By means of this concentrations, private investments try to adjust to the new economic moment. The iniciative started to demand new instruments of juridical action that allow international economic interaction and preserve the free competition in local market. Competition and market regulation must coexist in benefit of competition and customers. The Administrative Council for Economic Defense CADE as the responsible to control and fiscalize the competition in Brazil, and in view of increasing the competition between nacional companies, has the mission to deliberate about anticompetition behavies. The present research purporsed to identify juridical aspects that allow the merger between Brahma Co. and Antarctica Co. be approved, creating the American Beverage Company (AmBev).
