RESUMO

The purpose of this study was to analyse the theme of fundamental rights in the privates sphere, i.e. the function of fundamental rights in the relations between privates and when the State is not one of the actors envolved. To reach this purpose weve studied the Brasilian doctrine and cases and also the international ones and, in the last chapter, weve tried also to think in a way to solve the problem of the aplication of fundamental rights in the privates sphere using the rule of proportionality
