RESUMO

This dissertation intends to demonstrate that legal aid (the Public Defenderâs Office) may and must work as a true mechanism to prevent litigation. Nevertheless, in order for that to happen, it is necessary to review concepts of certain institutes that constitute procedural law. The procedure must also be seen as a mechanism to avoid future litigation by anticipating it. Jurisdiction, action and procedure must have a preventive focus, with conciliation, via legal aid, as one of the ways to attain, with more efficiency and rapidity, the interests of society. The equality of opportunity must be guaranteed to the citizen so that everyone can get to court, the parity of arms ensured by the State to those less fortunate, thus making up for the deficiencies brought about by inferiority, either cultural or financial. It is the legal aid (the Public Defenderâs Office), playing a preventive role via the institute of conciliation, the constitutional assurance that the access to justice should not be merely formal, but also effective
