RESUMO

Nowadays, the environmental crisis, experienced by society, resulting from awareness of damages that come from continuous depletion of natural resources caused by human actions, has introduced the environment in the worlds political and economic scenery. Nevertheless, concerns about environmental preservation are not shared in the same way by all the global societies. In spite of current legislation in Brazil, a great part of the population does not, ordinarily, express the environment value protected by the Constitution. The comprehension of the dichotomy between what the brazilian environmental law dictates and what society effectively expresses about the theme, may be understood by a history, marked by extractvism and by mistakes derived from the idea of endless natural resources, that has existed since colonialism. Environmental issues are directly linked to the interests of the entire community. They can not be analyzed exclusively by the predominance of individualities. The correct use of constitutional environmental principles, and also of environmental policy procedures, such as the environmental impact assessment and the environmental zoning, may help the diffusion, as well as the assimilation by society of the environmental value protected by law, as far as its applicability may minimize economic damages resulting from environmental impacts as illustrated by the process of land division registration in an area named Cidade Aracy, located in São Carlos, Brazil.
