RESUMO

The beginning of Genetic Engineering is an important event for the Sciences. Since of the development of this technique, also known as Technique of ADNRecombinant, it becomes possible to produce Genetically Modified Organisms (GMO). In 1996, the GMO started to be released in commercial scale. This fact brings a lot of polemics around of the eventual risks and benefits of this new technology and its impacts in the health, Economics and environment. One of the risks produced by the GMO is Genetic Pollution, that represents a invisible and unpredictable form of pollution, inside of the context of Risk Society, theorized by Beck, characterized for the new forms of risk that comes with the post-industrial era and that face of the scientific uncertainty about the relation of cause and effect, because of the impossibility of Sciences in precise the real impacts produced by this activities. In this scenario, Law plays an important role to prevent, minimize and inhibited eventual colateral effects that comes of the GMO. In the Brazilian System of Law, it is important to detach the role of the actual Law n 11.105/2005, that cares basically about activities involving GMO and the Biosafety. The Biosafety represents one of the forms of inhibited or avoid the Genetic Pollution, considering the Precautionary Principle. The subject inserts in the Society and Law Research area, because it is destinated to study of Law and its relationship with the new forms of risks that are typical of twenty one century and its impacts in the socioenvironmental ambit. In the same way, this present paper is associated with the concentration area of Economic and Socioenvironmental Law, because it analyses the Genetic Pollution, whose effects could disturb the biodiversity and the right of ecological balanced environment and health quality of life in the context of contemporaneous society.
