RESUMO

This present study aims to contribute to the debates over the role of labor regulation, by questioning if flexibilization on labor law can be made possible in the form proclaimed for economists and jurists or if it has other interests, as for example, the dignity of the human being in conflict with this prescribed form of the job relations. Therefore, it has in the Labor Law its main problem â the flexibilization â and in the Brazilian and foreign Constitucional Law the recital of a more harmonious solution for the question. In this way, it is essential the study of the theory of the essential nucleus or content of fundamental rights, once that the flexibilization spread out in Brazil, depends on the alteration of the constitutional legislation, what imposes a study on the sistematic conception of the basic rights, the use of proper terminology, the historical boarding, the subjective and objective perspective and conceptual deed of division and material. Necessary also it is to approach effectiveness of the basic rights; on the formal limits, material and secular, the protection to the essential nucleus of the basic rights and the trends of world-wide modification in Labor Law, over all with relation to the modifications by means of the flexibilization, withholding us more specifically in the analysis of world-wide the experimental relation of flexibilization with the Brazilian reality. It is in this scenarium that if it intends to nullify the considered problem, being without a doubt only one first step in this vast way that however if presents as an object of to be unmasked study
