RESUMO

This research is an investigation about the laws of the elementary public education decreed by the sucessive mandates of the Legislative Assembly and approved, or not, by the presidents from São Paulo Province.For this purpose we got the relation, the classification and we wrote about the laws of the elementary public education having as main topics the first general law about elementary public education approved on March 16th, 1846 and the respective regulations of September 25th and November 8th, 1851. We also studied law number 54 of April 15th, 1868 that reformed the school structure and revoke the law from 1846 which had been valid until that momento When we chose this type of document we decided to show the action of the state in relationships with the institution of the public education. The other documents used will also be talking about this field of action of the state divided into provinces as well as the annual reports written by the presidents of the Province found in the records of the sessions of the Legislative Assembly, specially the part conceming to the elementary public education. The period studied was between 1834 and 1868 starting from the Addition Law that decentralized ali the administrative structure of the empire transferring to the provinces ali the responsibilities of the society organization including the ones referring to the public education. They had from this period on to legislate about the elementary and secondary educations. So in that moment was created the new division of powers transferring to the provincial govemment the responsibility ofthe education of São Paulo population. The continuity proposed until 1868 considers the reform of the public education that happened in that year as a defined mark of a new education conception that was determined from the second part of the nineteen century on, noticeably marked by the defense of education as one ofthe basis ofthe country development and the people civilization. We took as a major reference the defense of a monarchic system that was based in a constitution and by a sequence of laws that followed the general principIes foreseen in it and we tried to analyze the action of the state to build a proposal of elementary education for a part of the population of São Paulo Province
