Visão difusa do direito: vieses da sua complexidade através de um olhar sistêmico

RESUMO

This study addresses the need to use initially systemic lens for assessing the interests and rights of collective and so inter, multi and trans disciplinary pacts in situations relevant web man-society-environment-law, drawn from scientific theories of different fields of knowledge and perception of natural realities. Revealed the web, which is used in their interests and rights of collective and class, scan it and then the need to extend the look of complexity to those realities. Abroad the doctrine of Claus Wilhelm Canaris (systematic thought) of Edgar Morin (concept), Boaventura de Sousa Santos (scientific knowledge socially constructed), aiming to capture the contemporary scientific view, focused on the integration of sciences and disciplines concerned with the preservation of the relationship situational man-society-environment-law. The integration of studies of these theories can build scientific knowledge, theoretical and practical legal knowledge needed to bring together the concretion of interests and studied all aware of its importance in protecting the interests, national and transnational. The research addresses the legal education of university postmodern, making considerations on the construction of scientific knowledge theoretical and practical contemporary. Presents teaching methodology that seeks the effectiveness of learning interests and rights of collective and class, from different professional attitude by affection. Research conducted at PUC / SP illustrates the situation. Stands out urgent need to bring the studies in the academies to scientific theories, by reflection on the interests, needs and contemporary conflicts. The complexity of the realities identifies the need to use the lens in the treatment of diffuse relationships highlighted, from contemporary approach, the research showing that knowledge is built from a new vision of reality projected. The concepts and theories brought to facilitate the search and identification reflection of the complexity of post-modern society, the emerging paradigm indicates insecurity and ignorance of history. The lens system is complex attempt to understand the scope of interests and needs that reveal the man in the family, regional, community, national or international, that must be addressed humanely and science, from ethical and conscious, establishing dialogues fruitful between different dimensions and different actors who act out the stages of life.The online research then is the "realization of the rights of third dimension and the protection of the community, the people and of humanity", the project developed at PUC / SP, entitled "Fundamentals and effectiveness of the interests and rights of collective and class"
