RESUMO

The subject chosen for this dissertation, Corporate Social Responsibility as a way of social inclusion legal aspects (CSR), aims at researching to what extent organisations can contribute to social inclusion, through the practice of social responsibility. Besides mentioning ways of how such collaboration may occur, it was studied the role of a company vis-à-vis the social, economic and cultural inequities, and also the strong discrimination in the working environment, factors of social exclusion. The purpose of this dissertation is to study CSR, encompassing its historical aspect, concept, dimensions, procedures and people involved for its execution; emphasizing social responsibility as a practice of business administration, based upon ethical principles, transparency, solidarity and care for the collective, further than the simple obligation to respect the legislation. To present the legal aspects, mainly the ones encompassed by the constitutional law and labour law. The social responsibility encompasses the way an organization deals with both the internal public (way how treats its workers) and with the external public (way how collaborates with the society through social projects) in a balanced way. In the internal ambit, we emphasize the issue of discrimination and lack of diversity in the working environment, focusing the role of the organisation for the social inclusion, through the valorisation of the work of women, the adolescent, the handicapped, the aged, and the possibility of an effective communication between the organization and the workers. In the external ambit, we will address the role of the organization for the social inclusion, through the realisation of non mandatory social projects, in the benefit of the entire society. We mention the Brazilian norm on social responsibility, NBR n 16001, from ABNT, and the future international norm on social responsibility, ISO 26000, which is underway, positioning CSR as a future view for the economic sustainability of organizations, as well as for the construction of a society with more fairness and solidarity, with a business objective broader than simply obtaining profits. Lastly, we mention some cases of socially responsible business administration, exemplifying how the organization can contribute to social inclusion. The examples, surely, reinforce the approach developed and confirm the possibility to apply Corporate Social Responsibility, with a great opportunity of success for all those involved.
