RESUMO

The present dissertation aims at addressing secularism and religious freedom analytically, from their historical evolution up to the current juridical and constitutional treatment they receive in Brazil. The choice of this theme has been influenced by important recent facts, such as, for instance, the apparent opening of the country to African-Brazilian religions, which are in a minority. Religious freedom has been placed within the category of "fundamental rights" and has been stressed as a right which is essential to the dignity of the human being. This stems from the evolution of these rights from Pre-Historic Times up to the present State. By focusing on religious freedom, attempts at a concept of religion have been exposed based on the opinions of distinguished history scholars. On continuing to break down this right, the freedoms of belief, of cult and of religious organization have been studied, as well as the various kinds of relationship between religion and the State. I The path taken by religious freedom and secularism in Brazil has also been studied, from the Pre-Colonial period up. to the Federal Constitution of 1988, focusing finally on the way these themes are current1y addressed in terms of juridical order, including in reference to the jurisprudence in the country
