RESUMO

In this thesis, public policy implementation has been approached based on policy analysis and theoretical public policy reference applications as developed in Brazil. The research herein refers to the implementation of public policies in enforcing adolescent out-laws from a perspective of human rights driven towards the protection of children and adolescents, based on the Child and Adolescent Statute (ECA), carried out and effected by the Brazilian National Government from 1990 to 2006. Furthermore, this research is based on a reference framework of interpretative and descriptive analysis. The research object is the locus in which we try to re-read the process of public policy implementation under a two-fold view: a focus in the decision-making process and another in the policy management process. In the end, three aspects have become relevant: 1) the dynamics of the political process and the exercise of power; 2) the building of mutual agreements and adjustments; and 3) the building of the policy based on organizational arrangements or arenas at the national level. This research is promising to the extent that it contributes to understanding the specificities of public policy-making in Brazil. We notice the concepts used herein have been taken first as a rational or control-based decision-making model, then later as a social process, and finally as an institutional process of negotiation between the government and the society oriented towards governance models.
