RESUMO

This objective study to demonstrate as the public politics of the Agricultural Providence if effective in the state of Sergipe. One searchs to know some effect generated in the microcosm of the familiar unit of the agricultural worker and the papers that have been played for the INSS and agricultural unions. To all understand the process of constitution of the previdenciária politics, a study of the paper of the State and the Social welfare after implanted the Federal Constitution of 1988 became that it resulted of the comprometimento of the Brazilian State in assuring the social and individual right of action , the freedom, the security, well-being, the development, the equality and justice. From this new social order, the Providence if has detached as one politics that it searchs to minimize or to solve the problems caused for the oldness, illness, unemployment and invalidity of great part of the mass of urban and agricultural workers. For the agricultural workers the Social welfare had positive impact a time that brought the possibility of income during the phases most difficult of the life of the worker, which is: oldness and illness. The agricultural workers who work in regimen of familiar economy, or either, the ones that they together exert activities with the members of the family in the condition of mutual dependence, without permanent employees, are part of a category of special called workers insured, therefore as they do not have fixed remuneration they cannot contribute monthly with the Providence, being, therefore, fit of bonanza form in the General Regimen of Social welfare - RGPS. The benefits the one that make jus this category of workers are retirement for age, retirement for invalidity, sick pay, wage-maternity, pension for death and aid-reclusion. The data raised in the year of 2009 through this research demonstrate that the sergipanos agricultural workers face many difficulties to see granted its order of previdenciário benefit, a time that the INSS very follows bureaucratic rules taking them, most of the time, to have that to ask for the benefit through action at law. The agricultural unions have been important agents in the conquest of this right in the measure where they assist the agricultural workers in the document collection well that proves its conditions of familiar agriculturists, as they give orientações regarding the Agricultural Providence. The results of the research also demonstrate that the Agricultural Providence makes possible the guarantee of the sustenance and the improvement of the quality of life of the agricultural worker and its family.
