Políticas públicas para a educação superior na década de 90 : efeitos da avaliação para o ensino de graduação : o caso dos cursos de direito

RESUMO

This study analyses the evaluation system implanted in Brazil in period 1995/2002 as the main public politics for the higher education; and identifies its effect for higher education from the results produced by external evaluations. Considering the amplitude of the available data and the limitation of time, the study was restricted to the analysis of the results on the graduate courses in Law. Initially, from the analyses of the characteristics that marked the development of higher education in Brazil, the study presented the bureaucratic and notarial model of control established during this period. Next, in the context of the general process of State reform, considering the characteristics that had marked the development of higher education in Brazil since its implantation until the beginning of the decade of 90, the evaluation system is analyzed from its normative configuration and its main instruments of external evaluation, specifically, of the graduate courses. The referring aspects to the analysis of the evaluations results of the graduate courses in Law are initiated with the presentation of the situation of the legal education in Brazil from its paradigm of crisis. The main proposals of overcoming developed by CEJ/OAB and CEED/SESu/MEC are emphasized. Following this contextual framework, the study presents the data of the expansion of Law courses in Brazil, from which it was possible to verify a significant growth of the number of courses and vacancies in the period. The results obtained on the National Examinations of Undergraduate Courses and Evaluation of Undergraduate Courses Conditions Offer shows important characteristics of the education system, generating an information until then inexistent: the knowledge of the real conditions of higher education in Brazil and level of attendance for the institutions and courses of superior level to the standards of quality then established by the public power
