RESUMO

"Penal State and Emprisoned Youth: a story of confinement has the objective to show the unfolding of the punishment increase related to the infraction in the youth during the period from 1995 to 2004, in the Febem-SP (Brazilian juvenile detention system in São Paulo). The period corresponds to the presence of the Penal State, thus assigned by Loïc Wacquant, incorporating elements of the tolerance zero doctrine. It also intends to present the history of the confinement of young people since 1902, when it started with the authorization for the construction of the Institute for Discipline in São Paulo, up to the present time with the creation of Febem - implemented since the dictatorial government by means of the National Policy for the Juvenile Welfare - emphasizing the measures adopted in the governments of Mário Covas (1995-2002) and Geraldo Alckmin (2003-2006). The research led us to the abolitionism reflection, which proposal of extinction of prison and revenge is based on the dialogue between the victim and the aggressor, for specific resolution of conflicts, generated by the situation-problem, apart from the universality of the criminal law.
