O sistema prisional brasileiro e os direitos fundamentais da mulher encarcerada : propostas de coexistência

RESUMO

The Brazilian prison system in the beginning of this century tends to a breakout point. The prisons are unable to reach their goals: deprive, prevent and re-socialize the inmates. Various strategies have already been tried and others are about to come out. In this environment in which the basic and fundamental principle of the dignity of the human being seems to have to value, and lots of men and women are stuck in prison doing their penal time or waiting for trial. Concerning the women the situation is even worse and preoccupying relating to the lack of attention and interest of the State Organs, the society and of those who study the inmates reality, that, once in a while turn their attention to the male prison situation, not the womens. In this context its urgent to point out some mechanisms able to diminish the number of imprisonment by the applying of alternative penalties and penal responses that come from the Recovering Justice. On the other hand, it is necessary that the effectiveness of the fundamental rights can be guaranteed in the system of imprisonment, and what will happen if: (1st) One could stimulate the participation of the community in the execution of the sentence; (2nd) One should establish a strong and efficient Public Defensive, able to concede a effective right of access to justice. The fundamental rights are a accomplishment of the constitutional principle of human dignity that should be guaranteed to each and every independent human being, regardless of the private characteristics or situations in which one has got.
