O problema de falÃncia: uma abordagem experimental acerca do comportamento dos agentes econÃmicos

RESUMO

The continuous necessity of improving the business environment has led the nations to reform their bankruptcy laws. Those reforms are many times inspired on foreign legislations aspects, with very distinct bias towards creditorsâ rights defense, and in Brazil it wasnât different. The old Brazilian bankruptcy system ages from 1945, and it was not compatible with the national economic dynamic anymore. Thus, in 1993, the discussions about the new law were started, being concluded in 2005, with the law 11.101 of February 9th. However, how could one guarantee that aspects inspired on foreign laws may be well applied in a local context, achieving the predefined goals for the new law? It was this question that stimulated this dissertation, which proposes to investigate experimentally â by hypothetical conditions â how social, cultural and economics aspects of the individuals can impact on their behavior in a typical bankruptcy problem, such as: the application of penalties to inhibit frauds or the individual insolvency, and specially the conflict between the creditors in splitting the bankrupted firmâs estate. Therefore, a questionnaire was developed and applied to graduation and post-graduation students from the Federal University of Pernambuco. The analysis of the answers was done through descriptive and inferential statistics, and this last one, especially by Bayesians Network â BN. As the first conclusion of the study, penalties, as an already expected result, reduce illicit activities. Furthermore, the usage of BN showed itself appropriate to achieve the goal proposed for allowing the identification of some behaviors not predicted by theory, like altruism and egoism that affect the expected results of the proposed rules. Moreover, the BN gave it an integrated view of the variables that cause those named behaviors, in other words, the BN indicates how social, cultural and economics aspects impact on behaviors related to bankruptcy situations, emphasizing the importance of evaluating those points when it comes to elaborating or reforming laws
