RESUMO

Law propaedeutics and fruitful scientific production, especially in the field of emergency procedures, point toward gargantuan challenges to be overcome not only by scientists but also by conventional interpreters. Since times have changed, reading has to be conducted under the light of the appropriate perspective for the regulatory discourse to attain the greatly aspired efficacy. This research paper intends to examine the regulatory discourse concentrating upon the relevance of the proportionality principle for emergency procedures. The first part of this research paper intends to position the contemporary hermeneutics model consolidated in constitutionalism, in other words highlighting its gravity center in the Constitution. However, the second part of the study is dedicated to the proportionality principle, which is of crucial support to protective measures. Nonetheless, since the insertion of this principle in the legal system requires a bridge that allows its access, the study of autopoiesis or Laws self-reproduction should be brought to light. After scrutinizing the hermeneutics setting in the first part of the study, and once the boundaries of the proportionality principle have been determined which are an indispensable mechanism for the effectiveness of Law enforcement in the second part of the research, the analysis focuses the urgent procedures. The last part of this paper describes protective measures of all kinds, be these injunctive relieves or judicial orders, highlighting a model usually referred to as mandatory protective measures, and which is able to encompass the general powers not only of the preliminary but also of the permanent injunctive relieves which are indispensable whenever the concrete circumstances are characterized by urgency and call for efficacious legal measures
