RESUMO

The aim of this thesis is to determine the Jus-Humanism as the fundamental theory to be apply in law science, that theory is the expression of absolutisms Principle of proportionality. This premise sets a course for the main theories of Law to point out its vacuity and to justify the application of the proposed theory. The significant content of jus-humanism is the intersection of normative positive law. Jus-naturalism, now recognized as human rights and legal realism, which is here defended its improvement in the circle of legal realism with its replacement by realism, the last one, based on judicial precedents and doctrine. From this perspective it is confronting the absolutisms Principle of proportionality and it applicability at Law Science, because this is the only one that requires in its framework and essence, the condensing rights, preserving its essential nucleous, thus, it would be the expression of jus-humanism
