RESUMO

This work is on Conservation Units aiming to study the technical and legal nature of the Management councils of the environmentally protected areas in Brazil. The objective was to analyze the legislation that established them, their current nature, composition and functioning and make propositions for their management.. A literature review on conservation biology and environmental law regarding the nature and objectives of the management councils of conservation units, especially of the Environmentally Protected Areas-APAs was the first step of this research. After acquiring the concepts and objectives of the management councils, further researches were undertaken to seek in the current Brazilian law, the gaps and main questions related to the ordinations of the management councils of the Conservation Units (SNUC). The law n 9.985, of July the 18th 2000, that established the National System of Conservation Units, the Federal Decree n 4.340, of 22 of August of 2002, that regulamented the SNUC, and the Normative Instruction n 02/2007 of the Chico Mendes Institute for Conservation of the Biodiversity (the brazilian governamental agency to promote biodiversity conservation), amongst other legislations were analyzed. Based on the questions and gaps identified in those laws and rules and in theoretical grounds, a research was conducted in documents produced by the governmental organizations, at a federal level and also at a local level in the Federal District on the functioning of the management councils of the APAs. . APAs were selected because they are conservation units that cointain preserves but also urban, rural and other uses in their territory, unders control of specific rules to allow their sustentability. The APAs that had councils already established were APA Gama e Cabeça de Veado, APA do Lago Paranoá e APA do Planalto Central. Based on the researches, the history of the composition of the councils and their funtioning were presented showing how these APAs have been dealing with the gaps and questions posed by the SNUC and the Decree n 4.340 and also presenting the reality of their current management. The reserach showed that the Management Councils (either Consultive or Deliberative) are participatory instruments that allow the civil society to share the administration of the conservation units towards in situ conservation, to define the occupation of the territory and also to prevent and solve conflits related to the use of natural resources.The APAs of the Federal District that showed greater success in reaching their objectives were those that invested in negociation and adopted a flexible process for negociation adapted to the ecological and cultural reality of their territory to form their management council. The more successful APAs were those that developed tangible and long term efforts to conserve the biodiversity and for environmental education of their inhabitants.
