RESUMO

The association of the growth and the legislation that rules the franchise system in the country, some questions are raised in order to find out the true reality in Brazil. That will be done comparing what is established in the law relating to the technology transfer and knowledge management, and going deeper in studying how that legislations has been performed. According to the law, the franchiser not only should sell the right to the use of the brand or patent and distribution of products or services, but also ought to transfer technology for the business implementation and the know how, as well as their operational systems. A comparative study was developed between two networks DF (Brazilian Federal Discrict) and Goiânia in the segment of teaching of foreign languages to identify the common practices of knowledge manageent and organizational learning, taking the experience and relationship between franchiser and franchisee. Some results are presented through interviews with ranchisees and a recent literature reviewing with the intent to share to find best practices of knowledge management and learning in the franchise system.
