RESUMO

This project aims to provide the identification of law standards regarding the freedom of conscience, as embraced by brazilian law, comparing national opinions to international rules, such as italian, french, portuguese and spanish current law. In order to achieve the objective mentioned above, it was necessary to analyze the law system, so as to bring out its own development and, by then, define the limits of personality law. By the identification of personality rights, it was compared to the private law, as well as to the fundamental law. This previous study brought out the ground to observe the righ of freedom of conscience, mainly focused on the elements of its law content, the implication of these elements with the imposition of the law and its limits. The discription of the right of freedom of conscience presented bases to identify manners to exercise it, thus by refusing to practice some determined acts which shall breach the conscience commands conscience rupture as by adopting active practices in order to promote certain overall view. By the research above summarized, the conlcusion is to confirm the possibility to identify a system of personality rights, that touches with fundamental rights, including the right of freedom, which, overall, aims to protect the conscience. In addition, another conclusion is that the exercise of that right shall be promoted by private actions, as well as by Public Authorities, and protected against injuries of any person, public or privite
