RESUMO

Thesis discusses the right to genetic privacy at ones area of employment. Begins by relating the rights of personality its definition characteristic and classification in order to confront questions regarding the use of genetic privacy. In analyzing this subject various problems arise such as definition characteristics and forms of access to the human genome the elements according to the law the subjects and limits to genetic privacy discussions involving genetic proofs and predictive or genomic medicine itself. To justify the existence of a right to genetic privacy Declarations Resolutions Recommendations and International Conventions especially the 1988 Federal Constitutional articles stating this right have been amalgamated. This thesis analyzes the right to genetic privacy at ones area of employment by examining articles CLT of NR-7 and Law 11.430/2006 considering bioethics such as vulnerability free and clarified consent procurement and utilization of genetic information confidentiality and secrecy of results. These points are contradictory to themes inherent to Labor Law such as the obligation of employer to perform medical examinations the preservation and safety of labor environment the employer freedom to hire. Confronting this collision of rights is the resolution of this conflict via weighing of interests via the utilization of reasonable and proportional principles. In the end the thesis acknowledges the existence of a right to genetic privacy at ones areas of employment indicating however critical steps to attain this right.
