RESUMO

This study has as an objective the analysis of Brazilian public policies with respect to Biofuels. Showing, through Brazilian juridical foundations, the sectors regulatory conditions and legal alterations that occurred with the promulgation of 1988s federal constution. The problem develops having as focus the Proálcool and Probiodiesel programs, describing some national and international experiences and observing the self sustained development, social inclusion, jobs and wealth generation, and the environment. It is pointed out the expanding international pressure toward the development of clean technologies, which aims to introduce to the worlds energy matrix non-fossil technologies, which has become a phenomenon towards the policies that aims the stimulation towards the substitution of petroleum based fuels for biofuels. The methodology used in the research has foundations in bibliographical and documental research. In the national circumference, the set of legal instruments occurred after 1975, having focus in the Proálcool and later the approbation of the bill n 11.097/05 related to the introduction of Biodiesel in Brazilian electrical matrix, points out. Internationally, it may be observed in the United States trough the clean air amendment of 1990, bill S-517, where were adopted new specifications for the fuels, intensifying the use of ethanol for better air quality. Concerning Biodiesel, the USA adopted the proportion of 20% trough the energy policy act, approved trough the American congress and signed in 2005, which establishes the directories of the electrical policies for next 10 years. In the European Union, trough the directive 2003/30/Ec of the European Parliament and of the Council of 2003 emerges a plan of action that establishes goals and amplifications for the use of biofuels for the entire EU based in the principles of proportionality and subsidiarity. The result of the collected analysis points to a bigger diversification and amplification in the plantation of plants that may produce oil for Biodiesel in the North and Northeast with some stimulation, taxes exemptions and governmental subsidies. Another need is a plan of policies for renewable energy using biomatter, aiming national supply and the new international demand, helping the generation of work, wealth and exchange value, things that are very necessary for Brazil to keep growing.
