RESUMO

The human person s dignity comes to the juridical world in a positivated way. However, it is not possible to ignore that this element is an intrinsic characteristic of the human being, bom with him. The principle of the human person s dignity created positively by the constitutional legislator brings an absolute value in its essence. This absolute value is unquestionable and it should be respected for the preservation and the guarantee of the Democratic State of Right maintenance. The world and the Brazilian penal right has already developed a lot since their creation. It is possible to say that the penal right and lhe penal sanction were always a part ofthe humanity s history. At the present time, the society presents itself with a new desire of punishment. The new punitive system tries to attack the human being as minimum as possible, respecting not only the guaranteed rights to the convict but also recognizing that these rights - as the preservation of the human person s dignity - are a piece of the own human being
